Canada's Judicial Immunity empowers unethical judges to perpetrate crimes
Most
Canadians blame crooked politicians for the cracks widening across our
society. We look at Ottawa or our provincial legislatures, venting our
fury at broken promises, ethical lapses, and the aggressive partisan
theatre on the nightly news. We operate under the comfortable assumption
that our democratic vulnerabilities lie entirely within the ballot box.
But this anger, while understandable, is profoundly misdirected. The
truly toxic actors undermining our nation rarely seek elected office. Why would they?
Running for public office invites the one thing a master manipulator
fears most: intense, unrelenting public scrutiny, financial disclosures,
and the unpredictable whim of the voter.
Instead,
the most calculating and unethical legal minds in Canada seek power
through a much quieter, far more permanent avenue—the judiciary. By
trading the campaign trail for the lifelong security of a judicial
appointment, they enter a realm where accountability disappears.
The Illusion of Political Corruption and the Path to Judicial Appointments
The
mechanism of this systemic subversion relies on a brilliant sleight of
hand. Many lawyers who step into the political arena actually start
their careers with genuine intentions. They want to serve their
communities, draft better laws, and improve the country. However, once
elected or brought into the machinery of governance, they find
themselves systematically assimilated into deeply entrenched, shadow
networks. These cabals are steered not by backroom politicians, but by a
select cadre of deeply unethical lawyers whose ultimate career
aspiration is a federal or provincial judicial appointment.
Politics
becomes a mere vetting ground or a favours-exchange network to secure a
seat on the bench. Once these individuals successfully ascend to the
judiciary, they unlock the ultimate shield: Canada’s absolute doctrine
of judicial immunity. From that moment onward, they are answerable to no
one but their peers, operating within an institutional fortress
designed to repel any attempt at external oversight.
Absolute Immunity as a Weapon: Escaping Accountability for Systemic Violence
In
theory, judicial immunity is supposed to protect the independence of
the bench. The orthodox legal argument dictates that judges must be free
to make difficult, unpopular decisions without the looming fear of
being personally sued by disgruntled litigants. In reality, this
absolute shield provides a rogue class of judges with complete cover to
ignore the rule of law with total impunity.
This
is not a matter of minor procedural errors, occasional
misinterpretations of case law, or judicial eccentricity. When corrupt
individuals hold absolute, unreviewable power, it leads to the systemic
destruction of human lives—amounting to what can only be described as
institutional crimes against humanity. Under the gavel of a compromised
judge, constitutional promises of a fair trial, equality, and procedural
fairness become entirely irrelevant. The Charter of Rights and Freedoms is reduced to mere scrap paper, brandished in arguments but entirely discarded in the final, pre-determined judgment.
Institutionalised Abuse Exposed: The Stark Reality of Carby-Samuels v. Carby-Samuels
This deeply dysfunctional environment was made abundantly clear in the Ottawa-based case of Raymond Carby-Samuels v. Horace Carby-Samuels.
This harrowing conflict began far outside the courtroom when an Ottawa
Police Detective, Robert Griffin, allegedly demanded that Raymond
Carby-Samuels remain silent regarding allegations that his mother,
Dezrin Carby-Samuels, was being subjected to severe domestic violence as
part of an apparent illicit medical experiment.
When
Raymond sought to challenge the actions of this detective and protect
his vulnerable mother at the Ottawa courthouse, he immediately collided
with a rogue network of judges. These actors actively worked to nullify
the interventions of heroic, ethical judges who were trying to safeguard
Raymond's mother from ongoing abuse.
The
mechanism of this network became undeniable after an ethical judge
finally granted Raymond the legal means to save his mother from horrific
treatment. In response, the network allegedly deployed its operatives
to protect the state-sponsored narrative and shield the perpetrators.
The Honourable Justice Sylvia Corthorn intervened in a manner that
completely bypassed the fundamental rights to a fair trial and
procedural fairness. Despite reports that the administrative judge, the
Honourable Robert Beaudoin, concurred with concerns over procedural
fairness, Justice Corthorn moved swiftly to neutralise the threat
Raymond posed to the ongoing medical experiment. Over the objections of
the presiding administrative judge, Justice Corthorn declared Raymond a
vexatious litigant—effectively stripping him of his legal standing,
barring him from filing further motions, and ensuring the pre-determined
outcome of the network remained unchallenged while his mother remained
trapped in a state of enforced isolation.
The Vertically Integrated Cartel: Forging Pre-Determined Appellate Outcomes
The
standard defence of the legal establishment is that the right to appeal
protects citizens from a rogue judge. If a lower court judge errs or
acts corruptly, the myth goes, a panel of appellate judges will
inevitably correct the injustice. This is a dangerous, systemic myth.
The reality is that these unethical actors operate highly integrated,
vertically aligned networks that stretch from Small Claims Courts and
provincial divisions all the way up to the Supreme Court of Canada.
The
integrated nature of these networks was explicitly revealed during
Raymond's attempts to secure appellate relief. Even before his case was
formally submitted to the Ontario Court of Appeal, the judges of that
bench utilised the Office of the Clerk to send disparaging remarks,
instructing Raymond that he ought not to oppose his father. This
extraordinary directive was issued despite verifiable evidence that his
father had been systematically abusing his mother and had previously
subjected Raymond to a near-fatal knife attack in the kitchen when
Raymond intervened to protect her life.
Rather
than reviewing the clear evidence of this violent subjugation, the
Court of Appeal judges refused to scrutinise the actions of John
Summers, the lawyer officially representing the father. For years,
Summers used highly unethical tactics to block wellness checks, defy
safety orders issued by ethical judges, and keep an elderly, disabled
mother completely isolated from her son.
The Whistleblower Revelations: Exposing Crown-Funded State Subversion
It
was only in 2026 that a whistleblower revealed the true, insidious
architecture behind John Summers' aggressive legal campaign. The
whistleblower uncovered that Summers—while ostensibly acting as private
counsel for the father—was secretly being funded by operatives of the
Crown. These state actors sought to perpetuate and conceal the medical
experimentation being inflicted upon Raymond’s mother. Within this
covert framework, Raymond's desperate legal efforts to secure his
mother's safety, restore her recommended speech therapy, and protect her
from severe physical neglect were viewed by the state network as
"interference" that needed to be aggressively neutralised.
This
coordinated obstruction relied heavily on complicit internal court
administrative personnel. These administrators acted as gatekeepers,
deliberately funnelling specific files away from ethical, independent
judges and directing them straight to affiliated judges within their
network. When Raymond finally approached the Supreme Court of Canada for
emergency judicial relief to rescue his mother from what amounted to
state-sanctioned emotional and physical torture, the highest court
simply ignored the filings. Even though an innocent human life was
hanging in the balance, the institutional network held firm, choosing to
protect its corrupt actors rather than uphold human rights.
The Illusion of Progress: The Charter as a Trap for Naive Litigants
The
profound implications for a public trained to believe that judges are
pledged to facilitate the rule of law and procedural fairness are
devastating. On paper, Canada possesses perhaps the strongest, most
comprehensive set of laws designed to protect human and civil rights in
the Western world. Because of this beautifully drafted facade, there is
likely no perceived ongoing injustice that a regular citizen has sought
to challenge in court without being dangerously naive. Everyday people
enter these grand courtrooms sincerely believing that the plain text of
the law is on their side.
This
systemic trap ensnares the most vulnerable segments of our society.
Consider the multi-generational efforts of Indigenous nations to legally
challenge the ongoing, toxic absence of clean running water on their
reserves. Look at the grieving families who lost loved ones due to the
systemic failures of governments to enforce our universal healthcare
system, only to find the courts closing ranks. Examine the Black
Canadians whose comprehensive class-action lawsuit against systemic
racism within the federal public service was unceremoniously rejected by
the Federal Court.
None
of these persisting social injustices are accidental or the result of a
"slow-moving" system. They are the deliberate, engineered outcomes of
well-organized judicial cabals working to shield the state and its elite
operatives from accountability. The laws exist to project an image of a
just society to the international community, but the judiciary acts as a
filter, ensuring those laws are never weaponised against the
establishment itself.
The Underdog Public Relations Mirage: Manufacturing Public Confidence
To
keep the public compliant and walking directly into this institutional
trap, the system relies on carefully timed illusions. Every now and
then, the judicial apparatus intentionally allows an "underdog" litigant
to win a major, landmark trial. These rare, isolated victories are
immediately seized upon and heavily publicised by corporate media
networks affiliated with the legal establishment.
These
highly theatrical cases serve a singular purpose: they act as cheap
public relations opportunities for a compromised establishment. They
inject just enough false hope into the public psyche to maintain the
myth of a fair, independent judiciary. The citizen reads the headline,
celebrates the triumph of the little guy, and concludes that the system
ultimately works. In reality, these highly publicised exceptions merely
obscure a grimmer truth: the machinery of Canadian justice is designed
to operate in a corrupt, protective manner in the overwhelming majority
of cases. The rare victory is the price the cabal pays to maintain its
legitimacy.
Conclusion: Exposing the Fortress and Importing Accountability
To
save Canadian society from an era of unchecked institutional tyranny,
Canadians must look past the superficial distraction of elected
politicians and demand a sweeping revision to the doctrine of absolute
judicial immunity. This structural overhaul is the only way to enable
everyday citizens to obtain the true judicial relief they rightfully
expect from the progressive laws that already exist on our books.
A
compelling blueprint for this reform lies just south of the border. The
United States operates on a rigorous system of checks and balances that
empowers its citizens to hold rogue actors accountable, often resulting
in substantial court settlements against institutional overreach. Yet,
the American system lacks the broadly progressive legislative framework
that Canada possesses to enforce quality of living, social safety nets,
and systemic social justice. If Canada were to bridge this gap by
adopting one specific U.S. legal innovation, Canadians would witness a
remarkable, rapid rebound in the severe social woes and widespread
alienation currently plaguing our society.
That innovation is the concept of "deprivation of rights under color of law."
In the United States, this framework criminalises the actions of public
officials—explicitly including judges—who use their state-backed
authority to systematically abuse power and violate civil rights.
Because Canada currently lacks a mechanism to challenge even the most
blatant conspiracies of corrupt judges coordinating pre-determined
outcomes with their corporate and legal associates, our nation's most
unethical lawyers are aggressively pursuing judicial careers. Judicial
appointments grant them the power to act as virtually untouchable gods,
perpetrating grotesque perversions of justice in plain sight.
We
cannot look to internal oversight for a remedy. The Canadian Judicial
Council acts as a rubber-stamping mechanism that routinely whitewashes
systemic corruption. This failure is inevitable: the elite judges who
preside over the Council are the products of a brutal, dog-eat-dog
institutional ecosystem where the most treacherous, well-connected
actors naturally rise to the top of the heap. Until the absolute
fortress of judicial immunity is dismantled and judges are made
criminally liable for abusing the colour of law, Canada’s celebrated rights will remain a cruel illusion.
