RBC Insurance faces second class action lawsuit

RBC Life Insurance Company is facing its second class action lawsuit over claims that it did not properly compensate its employees.

According to the Statement of Claim filed on August 06, 2019 by employment lawyer Andrew Monkhouse of Monkhouse Law, the insurer is being sued for $80 million for short-changing commissioned sales employees on vacation, public holiday pay, and unpaid overtime pay.

“We’re leading employee class action lawsuits in Canada because employers are getting creative about circumventing the Employment Standards Act that has been in place since 2000,” Monkhouse said in an official release.

Monkhouse also added that as one of Canada’s “Top 100 Employers,” RBC Life Insurance must respect employment laws.

Monkhouse Law had previously filed an order to certify an earlier class action lawsuit against both RBC Insurance Agency and Aviva General Insurance Company, which alleged that commissioned salespeople should have been paid vacation and public holiday pay based on their total compensation, and not just based on their base salary.

The previous lawsuit also sought $80 million in damages.
